Theoretically, you could write an offer on a restaurant napkin but nearly all Arizona home purchases use a pre-made contract form.
Many different contract forms are used to transfer ownership of residential real estate in Arizona. For example, most every Arizona home builder has its own specially written contract and the builders require home buyers to use the builders’ contract form.
Although every home builder has its own contract form, all home builder contracts have one thing in common, they are written to greatly favor the home seller (the builder) over the home buyer.
On the other hand, the vast majority of residential RESALE (not new) home sales in Arizona are written on the purchase contract form created by the Arizona Association of Realtors.
Arizona Realtors represent both buyers and sellers so the Association’s 9-page contract form is very even-handed between the interests of home sellers and home buyers.
When you fill out a contract form, it’s just an offer from you to the seller to buy the home with the stated price, etc. If the seller signs your offer, it then becomes a binding contract.
